These Terms & Conditions ("Terms") govern your access to and use of the MiniBiker website, products, and services ("Services"). By accessing our website, placing an order, or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.

Throughout these Terms, the terms "MiniBiker," "we," "our," and "us" refer to the operator of this website.


2. Eligibility

By using this website or purchasing any product, you confirm that:

  • You are at least eighteen (18) years of age or have the permission of a parent or legal guardian.

  • You have the legal capacity to enter into a binding agreement.

  • All information you provide is accurate, complete, and current.

  • You will use the Services only for lawful purposes.


3. Acceptance of Terms

These Terms apply to:

5. Definitions

For the purposes of these Terms:

"Customer" means any person purchasing or attempting to purchase a Product.

"Business Day" means Monday through Friday excluding public holidays in Hong Kong.

We make reasonable efforts to accurately display:

  • product descriptions;

  • specifications;

  • compatibility information;

  • photographs;

  • colors;

  • pricing.

However:

  • colors may vary depending on your device;

  • photographs are illustrative;

  • minor manufacturing differences may occur;

  • packaging may change without notice.

We reserve the right to improve, update, discontinue or modify Products without prior notice.


7. Product Availability

All Products are subject to availability.

We reserve the right to:

  • discontinue Products;

  • limit quantities;

  • reject unusually large orders;

  • refuse orders suspected of fraud;

  • cancel orders where pricing or inventory errors occur.

If payment has already been received, any cancelled order will be refunded.


8. Orders

Submitting an order constitutes an offer to purchase.

An order is accepted only when:

  • payment has been successfully authorized; and

  • we send an Order Confirmation or dispatch the Product.

We reserve the right to decline any order before acceptance.

Reasons may include:

All prices are displayed in the applicable currency shown during checkout.

The price charged will be the price displayed when the order is placed.

We reserve the right to correct obvious pricing errors.


10. Payment

We do not store full payment card details.

Payment processing is handled by secure third-party payment providers.

Orders may be delayed or cancelled if payment authorization cannot be obtained.


11. Shipping & Delivery

We will make reasonable efforts to process and dispatch orders within the estimated processing times displayed on our website. Delivery estimates are provided for informational purposes only and are not guaranteed.

Delivery times may vary due to factors beyond our reasonable control, including but not limited to:

  • Customs inspections or clearance procedures;

  • Carrier delays;

  • Severe weather conditions;

  • Public holidays;

  • Supply chain disruptions;

  • Incorrect or incomplete shipping information provided by the customer;

  • Events constituting Force Majeure.

Customers are responsible for ensuring that all shipping information is complete and accurate before placing an order. We are not responsible for delays, failed deliveries, additional shipping costs, or returned shipments resulting from incorrect information provided during checkout.


12. Risk of Loss

Risk of loss and responsibility for the Product transfers to the customer upon delivery to the shipping address provided during checkout, or as otherwise provided under applicable law.

Customers are responsible for promptly inspecting all deliveries upon receipt and notifying us within a reasonable period if the package appears damaged, incomplete, or incorrect.


13. Returns & Refunds

Returns, exchanges, cancellations, and refunds are governed exclusively by our Return & Refund Policy, which forms part of these Terms.

By placing an order, you acknowledge that you have read and accepted our Return & Refund Policy.

Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.


14. Product Compatibility

Customers are solely responsible for ensuring that their bicycle is compatible with the purchased Product before use.

MiniBiker provides compatibility information for general guidance only. Because bicycle manufacturers produce numerous frame geometries, cable routing configurations, suspension systems, and component variations, we cannot guarantee compatibility with every bicycle model.

Customers uncertain about compatibility should contact our customer support before purchasing.

Improper installation or use on an incompatible bicycle may increase the risk of product failure, loss of control, property damage, serious injury, or death.

Compatibility Verification

Compatibility information provided by MiniBiker is intended as general guidance and does not constitute a guarantee that the Product will be compatible with every bicycle, bicycle component, handlebar configuration, frame geometry, or accessory.

Customers are responsible for verifying compatibility before installation and use. If there is any uncertainty regarding compatibility, the Product must not be installed or used until compatibility has been confirmed with MiniBiker or a qualified bicycle professional.

A bicycle appearing visually similar to a compatible model does not establish compatibility.


15. Product Safety & User Responsibilities

The safe operation of the Product depends upon proper installation, regular inspection, routine maintenance, and careful operation.

By purchasing or using the Product, the customer acknowledges and agrees that:

  • The Product must be installed strictly in accordance with the official installation instructions supplied with the Product.

  • Before every ride, all mounting hardware, fasteners, straps, locking mechanisms, attachment points, and safety components must be inspected to ensure they are securely installed and free from damage, wear, deterioration, deformation, or loosening.

  • The Product must not be used if any component appears damaged, loose, missing, worn, cracked, or otherwise unsafe.

  • The Product must never be modified, repaired using unauthorized components, or used in any manner inconsistent with the supplied instructions.

  • The child must always be properly secured using the provided restraint system.

  • The Product must only be used within the published age, height, and weight limits.

  • The bicycle itself must be maintained in a safe operating condition at all times.

  • The rider remains solely responsible for operating the bicycle safely and in accordance with all applicable traffic laws and local regulations.

  • Cycling inherently involves risks that cannot be completely eliminated, including the risk of serious injury or death, even when the Product is properly installed and used.

  • Failure to follow the installation instructions, maintenance recommendations, inspection requirements, safety warnings, or operating guidelines may significantly increase the risk of serious injury.

  • Users must immediately stop using the Product if any component becomes loose, damaged, cracked, excessively worn, deformed, or otherwise appears unsafe until the Product has been inspected and, where necessary, repaired or replaced.

16. Warranty

MiniBiker provides a limited warranty covering manufacturing defects for the period stated in our Warranty Policy.

The warranty does not apply to damage resulting from:

  • improper installation;

  • misuse;

  • abuse;

  • accidents or collisions;

  • normal wear and tear;

  • failure to inspect or maintain the Product;

  • unauthorized modifications or repairs;

  • use outside the intended specifications;

  • use with incompatible bicycles;

  • commercial or rental use unless expressly authorized.

  • improper storage;
  • corrosion;
  • environmental exposure;

  • failure to follow maintenance instructions;

  • use of non-approved accessories.

The Warranty Policy forms part of these Terms.


17. Limitation of Liability

To the fullest extent permitted by applicable law:

  • MiniBiker shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, business interruption, loss of use, or other economic losses arising from the use of the Services or Products.

  • Our total aggregate liability arising out of or relating to any purchase or use of the Product shall not exceed the purchase price actually paid for the Product giving rise to the claim.

  • Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer protection or product liability laws.

19. Third-Party Services

The Services may include or rely upon third-party providers, including payment processors, shipping carriers, analytics providers, advertising partners, and technology platforms.

Third-party providers operate independently, and their services are governed by their own terms and privacy policies. To the extent permitted by law, MiniBiker is not responsible for their acts, omissions, or policies.


20. Privacy

Your personal information is collected, processed, and stored in accordance with our Privacy Policy, which forms part of these Terms.

By using the Services, you acknowledge that your information may be processed as described in our Privacy Policy.


21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles.

Nothing in these Terms limits any mandatory consumer rights available under the laws applicable to your place of residence where such rights cannot lawfully be excluded.


22. Force Majeure

MiniBiker shall not be liable for any delay or failure to perform its obligations resulting from events beyond its reasonable control, including but not limited to natural disasters, pandemics, labor disputes, governmental actions, war, terrorism, cyberattacks, interruptions to transportation networks, utility failures, supplier disruptions, or carrier delays.


23. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.


24. Stop Use Immediately

The Product must immediately be removed from service if any component becomes loose, detached, missing, damaged, cracked, deformed or otherwise appears abnormal.

The Product must not be used again until it has been inspected and MiniBiker or an appropriately qualified professional has determined that continued use is appropriate.


25. Accidents, Crashes & Use of the Product

Use of MiniBiker products involves inherent risks associated with cycling and transporting a child by bicycle, including, but not limited to, falls, collisions, loss of balance, bicycle instability, injury, and property damage.

Customers are responsible for using the product in accordance with the applicable instructions, safety warnings, weight and age limitations, installation requirements, and applicable laws and regulations. Customers are also responsible for ensuring that the bicycle, installation points, components, and accessories are suitable and properly maintained before and during use.

To the fullest extent permitted by applicable law, MiniBiker shall not be liable for accidents, crashes, falls, injuries, or property damage to the extent arising from improper installation, misuse, modification, failure to follow safety instructions, use outside the stated specifications, unsuitable or improperly maintained bicycles, or circumstances beyond MiniBiker's reasonable control, except to the extent liability cannot legally be excluded or limited under applicable law.


26. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, Warranty Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Hyperloop E Limited concerning the Services and supersede all prior communications or understandings relating to the same subject matter.
